By providing your telephone number and agreeing to the consent on the corresponding mobile application screen, and as good and valuable consideration for any products or services offered or provided through the Spring Free website, including any subdomains and any web-based portal or dashboard that you may have access to from time to time (together, the “Website”), you expressly consent to receiving calls, text messages and other communications, including any that may be made or generated using an automated telephone dialing system, pre-recorded message, or artificial voice, from Spring Free EV, Inc. (“Company”) or any of our agents, representatives, affiliates, assigns, successors, attorneys, collection companies, service providers, non-affiliated third-party partners or anyone calling or contacting you on our behalf (collectively, the “Messaging Parties”) at the telephone number associated with your account that you have provided or may provide in the future to us (including any cellular or mobile telephone numbers), to the extent permitted by applicable law. Such communications may include but not be limited to account servicing notices, collection notices, marketing, promotional or mixed-marketing messages regarding Company’s or its affiliates’ products or services and/or other related products and services. You also give the Messaging Parties permission to communicate such information to you by e-mail or other electronic format. Automated messages may be played by a machine automatically when the telephone is answered, whether answered by you or someone else. In the event that an agent or representative calls, he or she may leave a message on your answering machine, voice mail, or send one via text.
You certify, warrant and represent that the telephone number(s) and/or email address(es) that you have provided to Messaging Parties are your personal telephone number(s) and email address(es). You understand that for any calls or text messages, your cellular or mobile telephone provider, internet provider or email provider may charge you according to the type of plan you carry and you are responsible for such charges. You also agree that the Messaging Parties will not be liable to you for any claims, damages, fees, inconvenience, annoyance or loss of privacy in connection with such calls, texts, or e-mails. You understand that anyone with access to your telephone or email account may listen to or read the messages, notwithstanding Messaging Parties’ efforts to communicate only with you. If any telephone number(s) or email address(es) you have provided to the Messaging Parties changes, or if you cease to be the owner, subscriber or primary user of such telephone number(s) or email(s), you agree to promptly give the Messaging Parties notice of such facts so that they may update their records. You understand that you are not required to enter into this agreement as a condition of purchasing or using any products or services offered or provided through the Website.
You understand and agree that, subject to applicable law, Messaging Parties may monitor and/or record any of your phone conversations with any of their representatives for training, quality control, evidentiary, and any other purposes. However, Messaging Parties are not under any obligation to monitor, record, retain, or reproduce such recordings, unless required by applicable law.
Opting Out of Telephone Communications
If you have the right to revoke text messages and calls to your telephone or to revoke artificial or prerecorded voice message system calls, you may exercise this right only by emailing support@springfreeev.com or by calling (424) 298 2409 and providing the telephone number and/or email address that you do not want to receive such calls, text messages or email from; or by replying “STOP” to any text messages that you receive to stop receiving such text messages at that number. To the extent permitted by applicable law, you may not revoke your consent to receiving account servicing or collection notices if you have an outstanding obligation with the Messaging Parties or one of their affiliates or if you are using one of Messaging Parties’ or their affiliate’s services. In addition, to the extent permitted by applicable law, your withdrawal of consent to non-marketing telephone communications may impact your ability to access certain products or services via the Website in the future.
